Directive on Transparent and Predictable Working Conditions in the EU – Report on national transposition
The report on the transposition of the Directive 2019/1152 on transparent and predictable working conditions in the European Union is designed to assist Member States with the transposition of the Directive into national law and contains useful clarification about the application of the Directive – which aims at improving working conditions by promoting more transparent and predictable employment while ensuring labour market adaptability – to seafarers.
First, it makes clear that certain provisions do not apply to seafarers and, secondly, it spells out that in case of conflict between the Directive on transparent and predictable working conditions and the Directive 2009/13/EC (implementing the social partners’ agreement on the Maritime Labour Convention, 2006,) the latter shall prevail.
ECSA monitored the drafting process of the report and provided input on the sector specific aspects and seafarers’ provisions through Business Europe (observer in the Member States expert group).
